THE CONSTRAINERS PRINCIPLES TO THE MAXIMUM PENAL RIGHT IN THE ECONOMIC ENVIRONMENT

The principles of the penal right constitute barriers for the exercise of
the power of the state. However, these principles only represent formal limits. The law and the morals are historical products. In another sense the paper of the organs of the state are defined by the constitution as supreme law in the country. In the economical crime the minimal penal law, the offensive conduct, legality and guilt constitute a limits of the power the state. The society is who can establish limits to the state power in the penal law
