Abstract

This article aims to analyze the role of the National Institute of Access to Information and Protection of Personal Data (INAI). To what extent does the Advisory Council of INAI encourage strengthening this body so that citizens' freedoms are protected when rights related to the exercise of access to information and the security of personal data are affected? The hypothesis put forward is that the deliberative and argumentative task of the Advisory Council is fundamental to enrich the decision-making by the councilors that make up the plenary of INAI by observing, criticizing, and recommending actions that should be oriented towards a better application of the provisions that allude to the right of access to information and the protection of personal data, within a framework of safety and security that is based on the institutionality of democratic values.
